Friend extremely scared? Jail Time?

Arrested for DUI in California July 2004-completed all classes and probation. He was arrested for a felony DWI in Texas 2 nights ago. Blew over legal limit. Did not wreck, but it was a felony DWI because there was a fourteen year old in vehicle. The mother of the child was in the vehicle too.

Probably won’t get jail time for a first offense in Texas, the California case may or may not play into it. Get a good lawyer, he can keep you out of jail. No lawyer, jail is guaranteed. There will be fines, and they won’t be cheap, long probation period, suspension of your license for a few months, and maybe a few months in county. Texas doesn’t play when it comes to DWI, but we also know it doesn’t help anyone to throw them in jail either. After your second or third offense in Texas, then you do real jail time.
